Introduction

The following term and condition have to the extent possible, taken account of the French National Syndicate of travel agencies (SNAV). If all the points are not covered in the below text, please refer to SNAV selling conditions. If points are covered in the below text, the same has to be taken as a reference. France By French (FBF) conditions and SNAV conditions will prevail over the member state where the booking is made, as the services are delivered in France.

Applicability of the agreement

This agreement ("user agreement") incorporates the terms and conditions for France By French (Martin Uniyal Hospitality Pvt. Ltd.) and its affiliate Companies to provide services to the person (s) ("the User") intending to purchase or inquiring for any products and/ or services of FBF by using FBF’s websites or using any other customer interface channels of FBF which includes its sales persons, offices, call centers, advertisements, information campaigns etc.

FBF Responsibilities

1. Your reservation

On receipt of the full amount defined as the first installment, FBF will reserve the itinerary as agreed on the final quotation shared with the consumer, subject to availability.

2. Your Financial Protection

FBF’s bank is HDFC. All payments that we receive, either through bank transfer or through our payment gateway, PayUMoney, will be compiled with HDFC before being transferred to France to secure the services agreed with the consumer. All Forex transfers will be taken care of by our partner, HDFC, following the process for international transfer rules in India regarding payment from INR to another currency. As per foreign exchange rules in India, the amount involved in the transfer to pay our supplier to curate your trip will be declared under payer’s name.

3. Prices guarantee

Prices shown on the website and sales materials are based on costs, taxes (GST) and exchange rates as on December 2018. Should this cost change it may be necessary to make a surcharge on the price of your tours. Should the price increase more than 10% you will have the right to cancel within 7 days of notification, without penalties. This guarantee excludes fuel surcharge and does not apply to any taxes or charges imposed by any government. No refund will be made if costs are reducing.?

4. Should FBF cancel or change your holiday

FBF reserves the right to change or cancel your booking in accordance with operating requirements or circumstances beyond its control.

Should change or cancelation prove necessary, we will give you reasonable notice thereof in the circumstance and where available, offer you a comparable alternative. Where cancelation is necessary a minimum period of 45 days’ notice will be given by us unless the circumstances leading to the cancelation were beyond our reasonable control.

If the change or cancellation is due to a force majeure not estimated by us, like political unrest, war or threat of war, riots, civil strife, closure of airport or ports, industrial dispute, terrorist activities, natural or nuclear disaster, epidemic or health risk, of other similar event beyond FBF’s control) we will give a full refund minus the cost of the flight ticket and service expenses incurred by us with respect to your booking.

FBF is not responsible for the cost of any other travel arrangements affected by cancellation or rescheduling.

5. Tour details and condition

The information on our website and sales materials is correct to the best of our knowledge as on December 2018 but we cannot guarantee that any item or amenity mentioned will be available especially where we have no direct control over it.

FBF will do their best, at their discretion to select accommodation, sightseeing trips and transportation to give you the best value for money.

FBF constantly strives to improve packages and trip itineraries, if such improvement can be made. If unforeseen circumstances beyond our control make changes necessary, we reserve the right to vary itinerary and to substitute with alternative hotels. We are not responsible for any other travel arrangement affected due to substitutions.

6. Visa

FBF is just a facilitator in the obtaining of your visa. In no case, are we responsible for you to obtain your visa.

None of our tours include the visa fees; it is to be borne in full by each traveler.

Inability to obtain your visa is not a cause for refund. In case you do not obtain your visa, then the cancelation policy will be applied as per the general cancelation policy from the time you notify FBF.

You are fully responsible for ensuring that you meet all the conditions to obtain a Schengen visa with French entry, and for following the process to obtain your visa before the departure date.

FBF is responsible for providing you a proof of your booking, a letter with the detailed itinerary which you will have to follow and your flight ticket booking proof, in case you have requested FBF to book your flight tickets.

FBF engagement is to share our knowledge regarding obtaining visa and support you through phone calls and emails to help you in the visa process, free of charge. We do not provide on ground man power services for visa application.

7. International Flight Ticket

FBF is just a reseller of flight tickets. In no case, are we responsible for delay or cancellation by any airline company. If cancelation or delay of flight leads to absenteeism in other services booked with FBF, full refund is not possible.

FBF will only book the ticket, thereafter it is your responsibility to follow and respect the rules fixed by the airline company you will travel with (Check-in time, number of luggage and its weight)

Since FBF reserves the right to change or cancel your booking in accordance to operating requirement or circumstances beyond its control, if you have decided to book your own flight tickets, we would like to inform you that in case of cancellation of your trip, FBF will not be liable to refund the amount of the flight ticket. We recommend user to book refundable tickets and refer to airlines terms and conditions before booking.

Your responsibilities:

1. General payment condition

Our payment gateway is provided by PayUMoney. In case of any queries regarding the payment gateway, FBF will strictly follow the term and conditions applied by PayUMoney. Regarding the privacy of your banks details, please refer directly to the private policy of the payment gateway i.e. PayUMoney. FBF does not register or capture any of your bank details or data as all payments are facilitated through our payment gateway.

All our tour prices include GST applied for travel services in India.

For your booking to be confirmed, FBF will wait to receive the full amount of the first installment of all the concerned travelers as per the booking process mentioned on our web platform and within the given time as mentioned on your final quotation.

In case of delay in the payment of first installment or non-payment of the full amount requested, FBF won’t consider your booking and you will be refunded of the same.

To validate your travel, FBF will wait to receive the full amount of the final installment, for each person concerned by the travel booked on our platform and in the given time, mentioned on your final quotation.

In case of non- payment, delay in payment of final installment or non-payment of the full amount requested, FBF will have to cancel your booking. In this particular case, amount of first installment is non-refundable.

All traveler / passengers should hold a PAN card and share it with us a per the government RBI law. The user also confirms that they are of legal age to make this booking. In case any of the travelers is a minor, FBF will require PAN details of the parent/guardian. The user further confirms that non-compliance of this provision may result in cancellation of the booking.

2. Payment solution proposed by FBF

All our payment solutions are free of charge.

Split and participative payment are facilities provided by FBF to help you in planning your trip. In no case will it exempt you to respect the general payment condition.

For split payments, first and final installment and for participative payment, final installment, each payer taking part in the completion of these payments is free to define the value of their payment. The only concern of FBF is that all the payments put together should reach the amount fixed in the final quotation and in the given time.

For participative payment, in case of non-completion of the full amount of the final installment with the participative funding the first installment is non-refundable. The part of final installment collected will be refunded to the owner of the user account managing the booking.

For split payment; in case of non-completion of the full amount of the final installment by each participant, in such case the first installment is nonrefundable. The amount received for final installment will be refunded to each payer of final installment in proportion of their participation for it.

For Split payment; in case of cancelation each payer will be refunded in proportion of their personal payment and as per our cancelation policy.

For participative payment; in case of cancelation only the owner of the user account managing the booking concerned will be refunded according to our cancelation policy.

3. Cancelation Policy

First installment is fixed by FBF to cover the international flight ticket in case you have asked us to procure it for you and the booking fees requested by our suppliers to secure the services you have asked us. As those expenses are not refundable to us, the first installment will not be refunded under any circumstances.

Regarding final installment:

Please find below the cancelation calendar applicable for fixed trip or non-private group trips:

Before 40 days of departure: (this does not include the booking services fee under first installment)

  • 40 to 30 days before departure: 80% of the final installment
  • 30 to 20 days before departure: 40% of the final installment
  • 20 to 10 days before departure: 20 % of the final installment
  • Less than10 days before departure: 0% of the final installment

In case of a private group trip, the same calendar is applicable if you want to cancel the overall trip (for everyone). If you want to cancel only for one person among the group, then the refund of the final installment for this particular person won’t be possible.

The above conditions are applicable for each and every case; no cancelation reason will lead to a special treatment from FBF as the above conditions are set by our suppliers.

4. Refund timeline

In case the consumer is liable to receive refund from FBF, same will be done as per the bank rules and regulations and within 10 working days from the date of refund confirmation from FBF’s end.

5. Change policy

If after your booking has been confirmed, you wish to change to an alternate date of departure, you may do so subject to availability and provide the new departure date. There will be additional costs involved when changing the date of departure. The cost of international flight is not refundable if there is no alternate flight available as per the revised dates.

The fee of our extra time spent to move your booking will be communicated to you and the change will be done only once you have agreed with this new cost that is payable.

Transfer of the package to another traveler is allowed, however both original booker and transferee should inform FBF at least 50 days before departure. If additional charges are requested by our supplier for such arrangement, this will then be charged to you as an extra cost to be paid before departure otherwise it will be taken by FBF as a ‘non-completion’ of the final installment (refer to general payment condition)

6. Insurance

  • 1) FBF is not providing any cancelation insurance and no cancelation insurance cost is included in the tour price. Only arrangements done by FBF regarding your trip are defined in the cancelation policy.
  • 2) FBF is not providing any repatriation insurance and no repatriation insurance cost is included in the tour price
  • 3) FBF is not providing any healthcare outbound insurance and no healthcare outbound insurance cost is included in the tour price

It is up to the traveler to arrange for a travel insurance which might cover the three above points and as needed for obtaining a Shengen Visa.

The insurance appearing on each FBF trip breakup are mandatory to travel with us and cover the following:

  • 1) Insurance for each mode of transportation used on French territory included in the trip you have booked.
  • 2) Insurance that your travel will be covered by another French travel provider in case FBF is no longer able to provide such services.

Your trip:

1. Details and condition

Please read carefully your final quotation for all the items included in the final price. No allowance or refund can be made for meals, accommodation, and excursions etc. that are not included in your final quotation.

FBF’s aim is to provide you a safe trip and create the best memories for you. FBF welcomes passengers with special needs or disabilities, please take into account the following:

  • - Passengers are required to tell FBF in advance your food preference (Veg , halal, etc. )
  • - Passengers are required to tell FBF in advance of any physical, medical or special needs that require accommodation/ consideration during travel.
  • - All passengers must ensure they are medically and physically fit for travel. FBF may impose safety requirements necessary for the safe operation of activities during the trip. FBF may also exclude an individual from participating in a trip or an activity if that individual’s participation poses a direct threat to health or safety
  • - FBF does not employ medical personnel. Any necessary medical assistance will be provided by local facilities at the passenger’s own expense. FBF is not responsible or liable for any losses or costs incurred as a result of a medical services or the quality of care provided. FBF will only be a coordinator to ensure that you will have access to the facilities required.
  • - During the trip FBF may make arrangements with carriers, hotel and other independent suppliers to provide travel services. These parties are independent entities over which FBF has no control.
  • Our passengers are requested to carry their own luggage to the transportation, during transfer and to their rooms.
  • - FBF may in its sole discretion, decline the booking of any passengers who cannot or refuses to comply with FBF’s present terms and conditions. FBF is not responsible for any costs incurred in the event of a passenger being removed from a trip. Passengers agree not to hold FBF or any of its suppliers liable under these present terms and conditions
  • - You are responsible for all arrangement costs from the point of commencement to the conclusion of your trip.
  • - There may be times when our keepers have to make a decision in your best interest or the best interest of the group. You agree to comply with the authority and decision of the appointed FBF keeper and the French laws. If you do not comply, disagree with our keeper’s opinion, are not compatible with the general enjoyment of other members in the trip or the smooth operation of our trip itself, we reserve the right to refuse to let you continue to be part of the trip. We do not tolerate the possession of illegal or restricted substance regarding the French laws (drugs, weapons, etc.). Any threat to the safety of the group or to our keeper’s well-being by you whether verbal or physical will be taken extremely seriously and will lead to the immediate termination of your trip. In such event, you will be responsible for your own repatriation and related cost and will have no claim against us.
  • - Passengers will be responsible for any cost incurred as a result of a damage or excess cleaning fees related to your accommodation or places visited. To avoid litigation you are requested to highlight any preexisting damage in your accommodation.
  • - Where the passenger occupies a motored vehicle seat fitted with safety belt neither the operator or services providers agents or cooperating organization shall be liable for any illness, injury or death nor for any losses damage or claims from any accident or incident if the safety belt is not being worn at the time of the accident.
  • - Passengers agree our keepers may take photographs or videos of you during the trip and this may be used in our brochures and advertising or publicity material without obtaining any further consent or payment in respect of such photograph and video.
  • - If any provision of this contract is held invalid or unenforceable by Indian courts, this provision shall be deemed to be re-written to give effect to the same purpose within the permit of the law. The validity and enforceability of other provisions shall be affected.
  • - If you are unsuccessful in Indian court in any legal action instituted against us, you agree to pay all our costs including but not limited to attorney/ clients cost.

2. Illness or absenteeism

In the event of your withdrawal from one of our trips after the commencement as a result of illness or any other reason, no refund will be made.

3. Exclusion

Airfares to and from your trip and airport port taxes are not covered unless it is part of your flight ticket. Passport and visa fees, insurance as mentioned previously, laundry, phone calls, beverages, meals not detailed in your itinerary, tips, items of personal nature, excess baggage, and all activities mentioned as optional in the itinerary.

4. Weather condition

Under no circumstances can we be held responsible for snow or weather conditions, nor can any trip be cancelled or amended by you at any time on the bases of snow or weather condition.

General:

Contracting parties The booking conditions detailed herein contain the entire contract between you and FBF. No representation, term warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation. This contract may only be changed by a director of FBF.

If the user agrees with our T&C and has organized the travel for other members of the tour then it’s the sole responsibility of the consumer who is booking the trip to ensure that other travelling members have read and agreed to the T&C. No dispute raise will be received under the circumstance that a passenger was not aware of the T&C.

Your contract is with us as a trip operating company. At any times and at our complete discretion we may nominate to you in writing any other company or person to have the benefit of some or all of those provision of this contract, which may then specify as if you had agreed the provisions concerned directly with that company or person in the first place as well as agreeing them with us. We may at our complete discretion assign all or any rights and liabilities arising under or by virtue of this or any other contract with you

Transportation companies, airlines and so on are not to be held responsible for any act, omission or event during the times passengers are not on board planes, transportation or conveyances. We rely on international conventions and national and international law which may apply to services provided by us, our suppliers or agents with respect to any claim of any nature brought by you against us as a result of the provision of these services.

FBF is not a carrier or hotelier, nor does it own aircraft, hotel or coaches. All booking with carriers, hoteliers and other service providers are subject to the terms and condition and limitations of liability imposed by those carriers, hotelier and services providers. Please note that some of these are limitations of liability in respect of death, personal injury, delay and loss or damage of baggage. Whilst we cannot be held responsible for such actions or those that are a result of any act or omission by any third party, we will give reasonable assistance despite. Please also note FBF cannot be held responsible for the failures of any of these parties to provide facilities or services for handicapped client.

1. Arbitration

Dispute arising out of or in connection with this contract which cannot be amicably settled may be referred to arbitration, if the consumers so wishes under the Indian or French court depending on the dispute raised. The application for arbitration and statement of claim must be received by the competent court within eighteen month of the date of return from the trip. Outside this time limit arbitration may still be available if the company agrees but international agreement does not require such agreement.

2. Data protection

Please be assured that we have measures in place to protect the personal booking information held by us. This information will be passed on to the principal and to the relevant suppliers for your trip arrangement. The information may also be provided to public authorities such as customs or immigrations if required by them, or as required by the law. Certain information may also be passed on to security or credit checking companies. We will only pass your information on to persons responsible for your travel arrangement. This applies to any sensitive information that you provide us such as, details of any disabilities or dietary / religious requirement. Where the data might be passed on for marketing purposes you have the right to opt out of future marketing. You also have the right to access the data held, which can be obtained by writing to FBF.

4. Indemnification

The User agrees to indemnify, defend and hold harmless FBF and/or its affiliates, their websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by FBF and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this agreement.

The user shall be solely and exclusively liable for any breach of any country specific rules and regulations or general code of conduct and FBF cannot be held responsible for the same.

5. Personal and non-commercial use limitation

Unless otherwise specified, the FBF services are for the User's personal and non-commercial use. The User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from FBF website without the express written approval from FBF.

Jurisdiction

FBF hereby expressly disclaims any implied warranties imputed by the laws of any jurisdiction or country other than those where it is operating its offices. FBF considers itself and intends to be subject to the jurisdiction only of the courts of Bangalore in Karnataka, India.
